Spalione Arrested for DUI
Singer Shelby Spalione was arrested for driving under the influence of alcohol (DUI) over two weeks ago while driving through the Studio City area of Los Angeles. Spalione, whose stage name was Shelby Cobra while she sang in the now-defunct, Disney-produced, all-girl band KSM, was spotted driving her truck with the dome light on and a passenger improperly seated in the cab next to her. According to reports, when local law enforcement agents pulled Spalione over, not only was her passenger not wearing a seatbelt, but Spalione displayed signs of possible alcohol consumption. The 18-year-old singer was chemically tested and her blood alcohol content was reportedly 0.15% --nearly twice the legal limit of 0.08%. Spalione was arrested and taken to the nearby Van Nuys jail around 2 o'clock in the morning and released from police custody about nine hours later. No word has been given as to when Spalione is due in court.
As any Los Angeles DUI defense attorney can tell you, the state of California has what is called a "zero tolerance" policy when it comes to underage drinking and driving. What that means is that any driver under the legal drinking age cannot have a blood alcohol concentration of more than 0.01% while driving. For drivers ages 21 or over, that percentage is 0.08%. As an experienced
Los Angeles DUI defense attorney can tell you, any underage driver with blood alcohol content above 0.01% is subject to criminal DUI charges. According to the California DMV, the minimum punishment for being an underage driver with a blood alcohol concentration of 0.01% or more is a one-year suspension of your driving privileges. An experienced
Los Angeles DUI defense attorney can tell you that punishments from a criminal court if you are convicted can range from probation to mandatory community service, alcohol education or rehabilitation classes to possible jail time depending on several factors such as your blood alcohol content at the time of your arrest, prior convictions and dangerous driving such as speeding or racing through city streets.
