Cabrera Arrested for DUI

Baseball star Miguel Cabrera was arrested several weeks ago near Lakeland, Florida.  Cabrera, who plays first base for the Detroit Tigers, was spotted by local law enforcement agents 110 miles southeast of Lakeland, where the Tigers were starting spring training for the upcoming baseball season.  According to police reports, Cabrera's car engine was smoking and when sheriff's deputies approached him.  Cabrera is reported to have smelled of alcohol and spoke with slurred speech, and at one point even took a swig from an open bottle of scotch while being questioned by deputies.  More deputies were called to the scene when Cabrera became uncooperative and refused to take a breath test.  Cabrera was reportedly handcuffed after getting out of the vehicle and wandering into the road with his hands up.  A deputy on the scene actually struck Cabrera three times in the thigh after Cabrera pushed in to him.  Cabrera was officially arrested on suspicion of driving under the influence of alcohol (DUI) and resisting an officer without violence.  Cabrera was taken to a county jail and released shortly before 8 the following morning after posting $1,350 bond.  Cabrera has struggled with drinking in the past, being arrested after an alleged domestic dispute with his wife after a night of heavy drinking.  At the time, Cabrera's blood alcohol content tested as high as 0.26%, over three times the legal limit for drivers driving under the influence of alcohol, which is 0.08%.  Cabrera was also reported to have spent three months in an alcohol rehabilitation program in early 2010.

Dealing with a drinking and driving charge can be difficult for anyone, but celebrities and athletes have an even more difficult time because their indiscretions tend to be splashed all over the internet, television and newspapers for the world to see.  If you have been arrested for DUI, the first thing you should do is find an experienced and skilled Los Angeles DUI defense attorney.  At Kestenbaum, Eisner & Gorin, LLP, our Los Angeles DUI defense attorneys have a combined 50 years of experience in successfully defending our clients against DUI charges.  One of the first places to start a defense against DUI charges is the unlawful police stop.  An experienced  Los Angeles DUI defense attorneyknows that, by law, law enforcement officials must have a valid reason to pull you over for a suspected DUI stop.  In most cases, this means they must have seen you driving erratically or illegally before they have a good excuse to pull you over and investigate whether or not you are, in fact, driving under the influence of alcohol.

If police failed to follow protocol when you were stopped or arrested, your Los Angeles DUI defense attorney may be able to have your case dismissed on the grounds that you were improperly stopped.  If you have been charged with DUI, call the  Los Angeles DUI defense attorneys of Kestenbaum, Eisner & Gorin, LLP today at 1-877-781-1570 to speak to an experienced attorney about your case.
