Montana Arrested for DUI
The son of former professional football legend and Hall of Fame quarterback Joe Montana, Nathaniel Joseph Montana, was arrested for driving under the influence of alcohol (DUI) last week. Nathaniel Montana, who is currently vying for the quarterback position for the University of Montana, was first spotted by local law enforcement agents speeding down a city street in Missoula, Montana on June 3rd. When the young Montana was pulled over by police, there were several people in his vehicle and it was shortly before 4 o'clock in the morning. Officers at the scene suspected Montana had been drinking and performed a field sobriety test, which Montana reportedly performed poorly on. The 21-year-old football player was arrested and released a short time later on $685 bond. Montana appeared in court later that same day and pleaded not guilty to DUI charges and speeding. The University of Montana has not yet announced disciplinary action for Montana, instead preferring to see how Montana's court proceedings resolve.
While Montana's arrest occurred in Montana, any Los Angeles DUI defense attorney can tell you that Los Angeles law enforcement agents take DUI quite seriously. And while Montana was 21 years old at the time of his arrest, the state of California has a zero tolerance policy for underage drinking and driving. If you speak to an experienced
Los Angeles DUI defense attorney, he or she will tell you that the minimum blood alcohol concentration for most people who get arrested for and charged with DUI is 0.08%. For an underage drinker, that blood alcohol concentration actually drops to just 0.01% before they can be legally charged with DUI. That same
Los Angeles DUI defense attorney can tell you that alcohol is not the only thing that can produce a blood alcohol content of 0.01%. Certain cold medications contain small amounts of alcohol, as do some breath sprays or mouth washes. Additionally, some medical conditions or even diets can alter the chemistry of your breath to make it appear as though you have consumed alcohol when, in fact, you have not.
