Ward Arrested for DUI
Professional football player and last season's winner of "Dancing With the Stars," Hines Ward was arrested for driving under the influence (DUI) of alcohol earlier this month in Atlanta, Georgia. Ward, who plays the position of wide receiver for the Pittsburgh Steelers, was driving his 2009 Aston Martin sports car through city streets around 2 o'clock in the morning on July 9th when Atlanta law enforcement officers saw him swerve and hit a nearby curve. Officers then saw him change lanes several times without signaling before pulling Ward over. Officers at the scene described Ward as being unsteady on his feet, swaying and being somewhat defensive, though cooperative. Ward was given several field sobriety tests, and then took a portable breath analysis test at the scene where his blood alcohol content was measured at 0.128%. The results of Ward's breath test at the scene, however, are not admissible in court as the Alco-Sensor FST that was used at the scene is generally deemed less reliable than other breath tests. Once arrested, Ward refused to submit to further chemical testing, which could result in the suspension of his driver's license even if he is not convicted of DUI. Ward was later released from a DeKalb County jail after posting $1,000 bond. If convicted, Ward is facing up to one year in jail and as much as $1,000 in fines.
While Ward's arrest happened in Georgia, it brings up some important points about being arrested for drinking and driving here in Los Angeles. As experienced Los Angeles DUI defense attorneys can tell you, California has what is called an implied consent when it comes to chemical testing for suspected impaired drivers. When you apply for a driver's license in this state, you actually sign certain forms that contain your consent to be tested for blood alcohol content if a Los Angeles law enforcement officer suspects that you are driving under the influence of alcohol.
Los Angeles DUI defense attorneys know that if you refuse to submit to chemical testing at the scene of your DUI stop or after you are arrested for DUI, you may automatically lose your driver's license. In many cases, refusing to submit to chemical testing to determine your blood alcohol content may also been seen as an admission of guilt if your case goes to trial. In these cases, it is imperative that you have an excellent
