Tudyk Arrested for DUI
Actor Alan Tudyk was arrested for driving under the influence of alcohol several weeks ago while visiting Santa Cruz, California. Tudyk is best known for his roles as Steve the Pirate in "Dodgeball: A True Underdog Story," and Wash in "Serenity." Tudyk was spotted by local law enforcement agents on January 30th driving 40 miles per hour or more on a city street where the posted speed limit was 25 miles per hour. The actor admitted to officers that he had had a few beers at a local bar and reportedly refused to take a breath analysis test after being pulled over. He was given several field sobriety tests, which he reportedly did poorly on. Tudyk was arrested and taken to a nearby jail where he submitted to blood testing to determine his blood alcohol content. Results for Tudyk's chemical testing have not yet been released. A current Los Angeles resident, Tudyk's court appearance has been scheduled for March 1st.
As any experienced Los Angeles DUI defense attorney knows, even just "a few beers" can find you charged with driving under the influence of alcohol (DUI). While many people do not consider beer a strong alcoholic drink, it still has quite enough alcohol to impact your blood alcohol content, especially if you drink more than one. A skilled
Los Angeles DUI defense attorney can also tell you that breath analysis testing and field sobriety tests are not entirely reliable methods to determine whether or not a driver is actually impaired. With breath analysis, certain diets, health conditions and even medications can give falsely high alcohol content results even if you have not been drinking. Field sobriety tests, which are physical tests such as walking a straight line or touching your fingers to your nose that law enforcement officials use to determine a person's sobriety, are also unreliable as the results are highly subject to the interpretation of the officer giving them. Being ill or tired can also cause many people to perform poorly on physical tests that require coordination. In Tudyk's case, his refusal to submit to a breath analysis test could also count against him.
Los Angeles DUI defense attorneys know that in this city, drivers actually have implied consent to submit to chemical testing if they are suspected of DUI. What this means is that all licensed California drivers are assumed to have given consent to chemical testing when they apply for a driver's license. Refusing a chemical test usually results in the automatic suspension of your license, and in some cases can be considered an admission of guilt.
