Kennedy Arrested for DUI
Former Los Angeles Angels infielder Adam Kennedy was arrested for driving under the influence last month, just days before he was to start spring training with the Seattle Mariners. Kennedy, who was part of the 2002 World Series winning Angels, was reportedly caught speeding by local law enforcement officials in Newport Beach, California on January 27th. Kennedy was having dinner with friends and is said to have left the restaurant around 8 in the evening. After pulling Kennedy over, police at the scene suspected him of driving under the influence of alcohol (DUI) and asked him to take a breath analysis test. While no official test results have been released, Kennedy claims his breath analysis tests revealed a blood alcohol content "a little above the limit" of 0.08%. Kennedy was then arrested at about 9:11 p.m. and spent the night in an Orange County jail before being released in the morning. Besides playing baseball for the Angels and the Mariners, Kennedy has also played for the St. Louis Cardinals, the Oakland Athletics and the Washington Nationals. No word has been given on when Kennedy's trial will start.
Kennedy has joined the very full ranks of professional athletes who have had run-ins with the law because of drinking and driving. Many people think that athletes and celebrities can get away with unsafe behavior such as drinking and driving, but any experienced Los Angeles DUI defense attorney can tell you that that is not true. A
Los Angeles DUI defense attorney knows that public figures such as Adam Kennedy typically have an even more difficult time with DUI cases because they get so much media attention. An experienced
Los Angeles DUI defense attorney can also tell you that breath analysis machines, such as that used in Kennedy's case, are not always the most accurate way for law enforcement officials to measure a person's blood alcohol content. Breath analysis machines, sometimes called breathalyzers, are well known to need particular care and maintenance to operate properly. In many cases, careless cleaning methods can lead to a build-up of alcohol residues that can accumulate in the machine throughout an officer's shift and lead to falsely high test results, especially towards the end of a shift. A knowledgeable
Los Angeles DUI defense attorney also knows that many breath analysis machines require very careful recalibration after each use or the machine will give inaccurate results.
