Simms Arrested for Driving Under the Influence of Drugs
Former Tennessee Titans quarterback Chris Simms pleaded not guilty in court last Thursday to charges that he was driving under the influence of marijuana stemming from a traffic stop in July of this year. Police at the scene testified in court last week that they pulled Simms over after he had made in improper turn near a police checkpoint in Manhattan. Police in the case assert that Simms admitted to having had four puffs of marijuana when he was pulled over, but in court Simms and his attorneys maintain that at the time he had only admitted to having had cigarettes, not marijuana. The arresting officer said when he pulled Simms over, the smell of marijuana coming from inside the car was so strong that it turned his tongue numb and gave him a headache. Police at the scene tested the football player for driving under the influence of alcohol, which proved negative. After being arrested, Sims refused to take a urine test, but was tested a second time for alcohol, which was again negative. Simms and his attorneys are fighting his driving under the influence of marijuana charges on the grounds that the arresting officers made in unlawful police stop and had no cause to arrest him. If found guilty of his charges, Simms could face up to one year in jail and up to $1,000 in fines.
While the seriousness of driving under the influence of alcohol has been well-documented in Los Angeles, driving under the influence of narcotics, including marijuana, or even certain prescription drugs is also a criminal offense, and Simms' case is not entirely unlike many driving under the influence (DUI) of narcotics cases.
