Indiana DUI Blitz
As a state that had over 8,800 alcohol-related traffic collisions in 2009, Indiana has gotten serious about keeping motorists driving under the influence of alcohol off the road this year. This past weekend the Indiana State Police made a concerted effort to blitz drunk drivers, arresting 350 drivers who were driving impaired because of alcohol consumption. The focused effort also yielded 370 arrests for a variety of other criminal offenses as well as over 3,200 traffic citations and 6,000 written warnings--impressive numbers for a state that has a population of roughly 6.3 million residents. Beginning at seven in the evening on Friday, state police combed the Indiana highways in search of drunk drivers until six the following morning.
Local law enforcement is no less zealous about finding drivers under the influence of alcohol in Los Angeles. While a statewide program such as what took place in Indiana would be difficult to organize in a state as large and as populous as California, the Los Angeles metro area is frequently targeted by local police officers looking for drivers impaired by alcohol consumption. Sobriety checkpoints, otherwise known as DUI checkpoints, are a fixture on many Los Angeles roadways every weekend, while police and highway patrol cars regularly stop motorists driving through the city or on local freeways. In the United States, strict laws govern how and when a citizen can be stopped by the police or highway patrol, as well as how arrests can be made. DUI checkpoints must be conducted impartially, and officers conducting the stop are not allowed to single out anyone who decides to turn out of the line leading up to the checkpoint. Random DUI stops on highways or city streets must begin with a motorist driving illegally or unsafely. Police cannot stop you simply because you "look" suspicious, they must, for example observe you speeding, swerving in your lane or running a stoplight before they actually have cause to pull you over. Even after they have pulled you over, an experienced Los Angeles DUI attorney knows that they must have some sort of evidence of your impairment such as the smell of alcohol on your breath before they can "reasonably" suspect you of DUI.
