Blackmon Arrested for DUI
College football star Justin Blackmon was arrested for driving under the influence of alcohol (DUI) this past Tuesday, which is especially surprising given that Blackmon is only 20 and not actually old enough to legally drink. Blackmon, who is a sophomore at Oklahoma State University and is a wide receiver on their football team, was said to have been driving back to Oklahoma after a trip to Dallas to watch the Dallas Cowboys professional football team play the New York Giants. Local law enforcement officials initially pulled Blackmon over around 3:45 a.m. after seeing him drive 92 miles per hour on a suburban Dallas highway where the posted speed limit was just 60 miles per hour. The arresting officer performed a field sobriety test and determined that Blackmon had been drinking. Under Texas state law, drivers under the age of 21 can be arrested for having any detectable amount of alcohol in their blood. Blackmon was booked into a local jail and released around 8 a.m. after posting bond. While Blackmon must return to Texas for a November 23rd court date, he is not facing jail time for his offense. Under Texas law, Blackmon's Class C DUI charge is considered a misdemeanor and is punishable by fines of up to $500.
Field sobriety tests are something of a sticky point for people arrested for DUI. As any Los Angeles DUI defense attorney will tell you, field sobriety tests can be highly subjective in nature and are not always reliable indicators of impaired driving because of alcohol consumption. If you have been arrested for and charged with DUI stemming from a failed field sobriety test, contact the
Los Angeles DUI defense attorneys at Kestenbaum, Eisner & Gorin, LLP right away. Our
Los Angeles DUI defense attorneys have a combined 50 years of experience in unraveling field sobriety test results and successfully battling DUI charges. Many field sobriety tests, such as walking a straight line or touching alternate fingers to your nose can be difficult for many people who are ill or simply tired and not at all impaired by alcohol. As many experienced
Los Angeles DUI defense attorneys know, passing or failing field sobriety tests often has more to do with the officer conducting them than with the presence of alcohol in your blood. Courts and law enforcement officials are even beginning to recognize this, which is why more and more DUI cases are starting to rely on breath analysis or blood alcohol concentration test results.
