Weaving Sues Victim's Parents for Negligence
A Connecticut man has turned the tables on the family of a 14-year-old boy whom he killed in a car accident in 2007. David Weaving is alleged to have been speeding and improperly changing lanes when he hit a local teenager, Matthew Kenney, who was riding his bicycle on the side of the road. Weaving, who had five prior arrests for driving under the influence of alcohol (DUI) with four actual convictions, was sentenced to 10 years in prison in 2008. While Weaving was not charged with DUI for the fatal accident, Matthew Kenney's parents sued Weaving last year for more than $15,000 in damages. Weaving, for his part, decided to counter-sue, alleging that Kenney's parents were negligent in letting the boy ride his bicycle without a helmet and is also seeking $15,000 in damages claiming wrongful conviction and imprisonment. The Kenney family says Weaving's license to drive should have been permanently revoked in accordance with Connecticut state laws in 1999 because of his multiple DUI convictions, which could have prevented their son's death. The state's Department of Motor Vehicles has acknowledged that Weaving's license should have been revoked and is now taking steps to ensure that other drivers with multiple DUI convictions are kept from driving.
