Leyritz Acquitted
Former professional baseball player Jim Leyritz was acquitted recently in a case that garnered a fair amount of media coverage and speculation. Leyritz was accused of driving under the influence of alcohol (DUI) on the night of December 28, 2007 when he crashed his vehicle into another car in Broward County, Florida. The driver of the car Leyritz crashed into, 30-year-old Fredia Ann Veitch, died as a result of the accident. Prosecutors in Leyritz's case were charging Leyritz with DUI manslaughter, which could have landed Leyritz in a Florida state prison for up to 15 years if he had been convicted. While Leyritz's blood alcohol content was tested three hours after the accident and found to be 0.14%, well above Florida's legal limit of 0.08%, jurors in the case agreed that the effects of a concussion sustained during the accident may have caused Leyritz to absorb even more alcohol into his blood stream after the accident and that his blood alcohol content may have been below the state's legal limit just before the accident took place. Testimony given by experts during the trial also pointed out that Veitch's blood alcohol content was more than twice the legal limit as she had consumed several alcoholic beverages before getting in her car to drive home after working a shift as a bartender. Leyritz was, however, convicted of misdemeanor DUI, which carries a maximum penalty of six months in jail.
