Cassidy Pleads Not Guilty to DUI
Former "The Partridge Family" star David Cassidy pled not guilty to charges of driving under the influence (DUI) today in a Florida court. Cassidy, who became a teen heartthrob in is role on the popular 1970s television show, was arrested in Fort Pierce, Florida on November 3rd after local law enforcement officials spotted him weaving through traffic and allegedly nearly hitting another car around 8 o'clock in the evening. When officers walked up to Cassidy's car, they say they smelled alcohol on his breath and later spotted a half-empty bottle of bourbon inside the vehicle. The 60-year-old actor admitted to having had wine with lunch several hours prior to being pulled over and also told officers on the scene that he had taken prescription medication, including hydrocodone. Cassidy was given several field sobriety tests, which he reportedly failed. Officers at the scene described him as "unsteady" on his feet. Cassidy was given a breath analysis test later and reportedly blew as high as 0.14%, well above Florida's legal limit of 0.08%. Cassidy is being charged with DUI, failure to maintain a single lane and driving with an open container in his vehicle. Though he pled not guilty, the actor could face up to six months in jail and as much as $1,000 in fines if he is convicted.
As any Los Angeles DUI defense attorney can tell you, being accused of DUI does not actually mean that you were driving under the influence of alcohol. At Kestenbaum, Eisner & Gorin, LLP our Los Angeles DUI defense attorneys know that field sobriety tests and blood alcohol science are not always as definitive as prosecutors would have you believe. Field sobriety tests in particular are highly subject to the interpretation of whichever law enforcement official is conducting them, and it is not only alcohol that can affect how well you do with them.
As experienced Los Angeles DUI defense attorneys know, being especially tired or ill can affect your balance, coordination and alertness.
Los Angeles DUI defense attorneys also know that breath tests are extremely prone to inaccuracy as breath analysis machines need to be cleaned and recalibrated often in order for them to give proper results. In many cases, residue from prior tests can get trapped in the machine and accumulate, leading to falsely high results for some unlucky person. If you have been arrested for DUI, call the
