DUI Field Sobriety Tests

For decades, Los Angeles Police and California Highway Patrol have used specific voluntary tests to determine possible drunk drivers.  Tests can vary, from putting your arms out to your sides and trying to touch your nose, to performing the alphabet backwards to standing on one leg.  The National Highway Traffic and Safety Administration (NHTSA) researched these DUI Field Sobriety Tests in 1977 and 1981 and provided a sound array of tests that could allegedly be fairly reliable in determining a driver's intoxication level.

Recently, former Sopranos actor Joseph Gannascoli found out how difficult it can be to be subjected to a DUI Field Sobriety Test.  Gannascoli, who played Vito Spatafore on "The Sopranos" was arrested for drunk driving on Friday morning in Florida.  He was making an illegal turn and drifting between lanes.  When police pulled him over, they smelled alcohol on his breath and noticed his bloodshot eyes and slurred speech.  When he took a DUI Field Sobriety Test, he allegedly blew a .111, which is above the legal limit of .08.  He was released after posting a $500 bond.

At Kestenbaum Eisner & Gorin, LLP, our Los Angeles DUI Defense Attorneys are familiar with how Field Sobriety Tests work.  Having been involved in the law for over 50 combined years, both as defense lawyers and prosecutors, we have a unique perspective on how police officers carry out the drunk driver tests.  We are also aware of the many mistakes and miscalculations police officers and sheriffs can make while administering DUI  Field Sobriety Tests.  Our defense attorney team is comprised of the kinds of professionals who can examine any case and fine the weaknesses therein.

A DUI Field Sobriety Test is designed to determine the presence of physical and mental impairment caused by someone being under the influence of drugs or alcohol.  However, there are countless cases of police misinterpreting medical conditions for drunkenness.  There are also cases of people being nowhere near the level of intoxication it takes to arrest someone for a DUI.  Only a skilled, experience Los Angeles DUI Defense Attorney can provide the kind of support necessary to give you everything you need for an excellent drunk driving defense.

If you or someone you love has been charged with a DUI, contact the Los Angeles DUI Defense Attorneys at Kestenbaum Eisner & Gorin today at 877-781-1570.  We can examine your Field Sobriety Test and give you the legal representation that you need.
