Professional football player Knowshon Moreno was arrested for driving under the influence of alcohol (DUI) earlier this month while driving near Denver, Colorado. Moreno, who plays the position of running back for the Denver Broncos, was initially pulled over by local law enforcement agents because he was speeding down a Colorado highway in what turned out to be a construction zone on February 1st. According to reports, Moreno's convertible Bentley was driving at 70 miles per hour in an area where the posted speed limit was just 45 miles per hour. Upon approaching the football player's car, officers at the scene report that Moreno smelled like alcohol. He was given a field sobriety test, which he reportedly performed poorly on. Ironically enough, the license plate on Moreno's vehicle read "SAUCED." Moreno, who officers say was "very respectful and polite," submitted to a chemical test to determine his blood alcohol level, but results have not yet been released. Moreno was arrested for DUI. No word has been given as to when Moreno is next expected in court.

Though Moreno's arrest occurred in Colorado, an experienced Los Angeles DUI Defense Attorney can tell you that driving under the influence of alcohol is taken very seriously here in California, as well.

Reality television star Shawn Pomrenke was arrested for driving under the influence of alcohol in Alaska last month after reportedly hitting a pedestrian with his car. Pomrenke, who stars in the Discovery Chanel's "Bering Sea Gold," was backing out of a parking lot on December 9th when he hit a pedestrian carrying groceries. Pomrenke then drove away from the scene after giving the pedestrian a grin and a thumbs up sign. Local law enforcement agents caught up with Pomrenke a short distance from the accident and say Pomrenke admitted to having consumed alcohol prior to the accident. Pomrenke also allegedly admitted to police that he did not have car insurance. Officers at the scene gave him several field sobriety tests, which he performed poorly on. When his blood alcohol content was tested by a breath analysis machine, Pomrenke reportedly blew 0.125%, well above the legal limit of 0.08%. Pomrenke, who is the co-owner of a gold dredge, was arrested and later charged with driving under the influence of alcohol, failing to return to the scene of an accident, driving without insurance and assault in the third degree. No word has been given as to whether or not the pedestrian Pomrenke hit was injured.

If you are facing DUI charges, you need an experienced Los Angeles DUI Defense Attorney to defend you right away. At Kestenbaum, Eisner & Gorin, LLP, our attorneys have over five decades of collective experience in defending people against DUI charges and we know exactly how to guide you through the complicated and often intimidating world of being charged with a criminal offense. An experienced
Los Angeles DUI Defense Attorney knows that for many people, being charged with a DUI may be their first brush with the criminal justice system. People who are otherwise law abiding citizens can make the mistake of drinking and then feeling they are still sober enough to drive themselves home. Your
Los Angeles DUI Defense Attorney can tell you that you have just 10 days from the time of your arrest to find an attorney and have them schedule a hearing with the California DMV or your driver's license will be suspended until the criminal portion of your case is decided. While DMV hearings do not carry the threat of jail time, they should not be taken lightly and are much easier to handle with an experienced attorney by your side. Your
Los Angeles DUI Defense Attorney can also tell you that field sobriety tests and even blood alcohol tests are not always accurate measures of whether a person was actually impaired while they were driving. Field sobriety tests are subjective and a person who is ill or even just tired can perform poorly enough on them to be arrested for DUI--even if they have not had a single drop of alcohol to drink. An experienced
Los Angeles DUI Defense Attorney can also tell you that breath analysis tests can be inaccurate because breath analysis machines are notoriously difficult to keep clean and require frequent recalibration in order to work properly. If you are facing DUI charges, call the offices of Kestenbaum, Eisner & Gorin, LLP today at 1-877-781-1570 to speak to an experienced and aggressive

Local stand-up comedian Angelo Bowers was killed in a car crash that local law enforcement agents say was caused by a driver who was under the influence of alcohol. Bowers and a friend, fellow comedian Josh Adam Meyers, were hit by an unnamed 21-year-old driver around 1:45 in the morning on Tuesday, January 3rd. According to police reports, the driver had also caused another traffic accident with a taxi near the intersection of Hollywood Boulevard and Argyle Avenue just minutes before and, in fleeing the scene of that accident, ran into the car with Bowers and Meyers. Bowers was reportedly the passenger in Meyers' vehicle. All three people involved in the accident were severely injured and taken to nearby hospitals for medical attention. Bowers died several hours later from his injuries. Meyers and the driver of the car that collided with his vehicle are still reportedly recovering from their injuries. The driver is expected to be arrested and charged with murder once he no longer requires medical treatment.

As an experienced Los Angeles DUI Defense Attorney can tell you, Bowers' death is a sad example of exactly why local law enforcement agents and legislators take drinking and driving so seriously: people can not only be seriously injured by impaired drivers, but can die as a result of someone else's bad decisions. If you are facing DUI charges, call the offices of Kestenbaum, Eisner & Gorin, LLP today at 1-877-781-1570 to speak to an experienced

Los Angeles DUI Defense Attorney can tell you that no DUI case is as black or white as law enforcement agents or prosecutors would make it seem. An experienced
Los Angeles DUI Defense Attorney knows that alcohol consumption is not the only thing that can make people drive erratically. In many cases, illness or simple fatigue can make people perform poorly on standard field sobriety tests. Breath sprays, mouth washes and even certain diets can alter the chemical composition of a person's mouth and lead to a falsely high blood alcohol content reading on breath analysis tests. Your
Los Angeles DUI Defense Attorney knows that blood samples are the most accurate way to test someone's blood alcohol content for alcohol impairment, but even blood samples are only as good as the technicians and laboratories that handle them. Labs and technicians can and do make errors that could make it seem as though you were driving impaired because of alcohol even if you were not. Facing DUI charges can seem daunting, but the right
Los Angeles DUI Defense Attorney can provide crucial guidance and defense for you. Call today to find out what your options are.

DUI Chekpoints

As any Los Angeles DUI Defense Attorney can tell you, sobriety checkpoints, also known as DUI checkpoints, are the subject of much debate in legal circles these days. Currently, the laws of the land allow for sobriety checkpoints, though under very strict conditions. In Edmonton, Canada, locals have taken to the social media site Twitter to announce sobriety checkpoints that they come accross, and local law enforcement agents are not happy about it. According to Edmonton police, alerting drivers to the presence of a sobriety checkpoint does not deter people from drinking, it only allows them to avoid the checkpoint and not get caught if they happen to be driving under the influence of alcohol (DUI). The Edmonton Police Department issued an official request that people not announce sobriety checkpoints on social media sites. This is a stark contrast to Saskatoon, Canada, where the local police department themselves take to Twitter to announce upcoming sobriety checkpoints and advising citizens to make other arrangements for transportation back home if they plan to consume alcohol. The Saskatoon Police Department believes that by announcing DUI checkpoints, people will plan ahead to avoid being charged with DUI.

If you have been arrested for DUI at a sobriety checkpoint, you need an experienced Los Angeles DUI Defense Attorney right away. At Kestenbaum, Eisner & Gorin, LLP, our attorneys have the experience that can only come from a collective five decades in defending clients like you against DUI charges. Your
Los Angeles DUI Defense Attorney can tell you that the reason sobriety checkpoints are something of a legal quagmire is because our nation's Constitution protects us from entrapment and unreasonable search and seizure by law enforcement officials. Officially, these laws are in place to keep law enforcement from bullying law-abiding citizens. Your
Los Angeles DUI Defense Attorney can tell you that sobriety checkpoints meet many peoples' definition of entrapment and unreasonable search and seizure. Checkpoints, however, seem to be here to stay because of public safety concerns—though with strict regulations. In Los Angeles, sobriety checkpoints must be announced to the public beforehand. Typically, an announcement is made in a local newspaper. Checkpoints must also not be placed in an area that would cause unreasonable traffic and law enforcement officials conducting the checkpoint must use an impartial formula to decide which vehicles to stop and check. They cannot decide to stop you simply because you drive a flashy car or look suspicious. An experienced
Los Angeles DUI Defense Attorney can tell you that drivers must also be allowed to get out of the line leading up to the checkpoint without law enforcement officials coming after them. If any of these procedure was not followed, you may be able to have your charges reduced or even completely dismissed. Call the offices of Kestenbaum, Eisner & Gorin, LLP today at 1-877-781-1570 to speak to an experienced and aggressive

Rapper Flo Rida was sentenced in mid-December after being convicted of driving under the influence of alcohol (DUI). Flo Rida, whose real name is Dramar Dillard, was arrested back in June of 2011 when local law enforcement in the South Beach section of Miami spotted the rapper driving erratically in his 2008 Bugatti. Officers at the scene reported that Dillard had bloodshot, watery eyes, slurred speech at the scene, and that they smelled alcohol on his breath. Dillard's blood alcohol content was reportedly 0.185%, more then double the legal limit of 0.08%. The rapper was also found to be driving on a suspended license. Instead of being sentenced to jail, however, the rapper will participate in the state of Florida's "Back On Track" program for first-time DUI offenders. As part of the program, Dillard will have to perform community service as well as take alcohol education classes. Dillard will also be expected to pay fees and court costs. If Dillard completes all the terms of his program, his DUI charge will be amended to reckless driving, which will not add points to his driver's license and makes him eligible to have his arrests and criminal records sealed.

If you are facing alcohol-related criminal charges, you need an experienced Los Angeles DUI Defense Attorney right away. Certain factors such as having a blood alcohol content well above the legal limit of 0.08%, speeding, driving with a child under the age of 14 or prior DUI arrests or convictions, however, could land you in a Los Angeles County Jail or even a California State Prison if you are convicted.

Television sports analyst Matthew Barnaby was arrested earlier this month in the state of New York on suspicion of drinking and driving. Barnaby, who worked as an analyst for ESPN, was pulled over near Clarence, New York around 3 o'clock in the morning on December 5th after sheriff's deputies responded to calls of a SUV driving erratically and while missing a tire. When local law enforcement agents caught up to Barnaby, they found him driving his Porsche Cayenne on three tires and just one rim, which was causing sparks on the roadway. His vehicle was also said to have had "significant" damage to the front end. Officers at the scene administered several field sobriety tests, which Barnaby reportedly performed poorly on. Barnaby refused a breath analysis test at the scene to determine his blood alcohol content and was arrested and charged with driving while intoxicated (DWI). ESPN terminated its contract with Barnaby immediately after news of Barnaby's arrest surfaced. Barnaby had also had legal trouble earlier this year when he and his ex-wife were involved in a domestic dispute in which Barnaby was charged with several related criminal charges. No word has been given as to when Barnaby is expected in court.

As any experienced Los Angeles DUI Defense Attorney can tell you, law enforcement agents take drinking and driving just as seriously here in Los Angeles as they did in the state of New York. Local law enforcement agents must have a reason to pull you over and examine you for potential DUI charges to begin with.

Former Miss USA winner Rima Fakih was arrested on suspicion of driving under the influence of alcohol last weekend. Fakih, who is the first Arab American to ever win the title of Miss USA, was reportedly driving through the Highland Park region of Detroit, Michigan when local law enforcement agents spotted her weaving in and out of heavy traffic, failing to signal for lane changes and speeding up to 60 miles per hour, which was well above the posted speed limit. The 26-year-old Michigan native was pulled over by local law enforcement agents just after two o'clock in the morning on Saturday, December 3rd. Upon approaching Fakih's vehicle, the officer at the scene reported that the beauty appeared "disoriented" and had slurred speech. Fakih immediately told police that the 2011 Jaguar she was driving was not hers and that she had borrowed the vehicle from a friend. Upon searching the vehicle, officers found an open and half-empty bottle of Moet & Chandon champagne on the floor behind the driver's seat. Fakih denied knowing anything about it. Fakih reportedly took two breath analysis tests and was shown to have blood alcohol contents as high as 0.20%, well above Michigan's legal limit of 0.08%. Fakih was arrested and taken to a nearby jail where she spent the night "until she was sober." Fakih is due in court on December 21st.

Your
Los Angeles DUI Defense Attorney knows that as in Michigan, California's legal limit for blood alcohol consumption is also 0.08%. Having a blood alcohol concentration of 0.08% or more means you can officially be charged with driving under the influence of alcohol, more commonly known as DUI. Being convicted of a DUI can have serious consequences for your life, including having your driver's license suspended, expensive fines, court-ordered alcohol education or counseling, community service, and even jail or prison time.
College football coach Gary Pinkel was arrested on suspicion of driving while intoxicated (DWI) while driving in Missouri in mid-November. Pinkel, who has headed up the University of Missouri's football program for the last 11 seasons, was pulled over by local law enforcement agents in Columbia, Missouri while on his way home from a post-practice dinner with friends. Pinkel was arrested and taken to a nearby Boone County Jail, and later released after posting $500 bond. Pinkel released a public apology expressing remorse for his lack of judgment. Pinkel's arrest comes just days after the University's dean met with campus professors to discuss the growing problem of alcohol abuse amongst students. According to reports from local law enforcement agents, no formal charges have been filed against Pinkel, though the county prosecutor has not ruled it out yet.

Los Angeles DUI Defense Attorney can tell you that this means law enforcement agents have to have a reason to pull you over if they believe you are driving impaired because of alcohol consumption. Officers are not allowed to pull you over simply because you are driving away from a bar or down a busy street on a Friday or Saturday evening. Officers must first observe you driving in a manner that is somehow dangerous or illegal. Your
Los Angeles DUI Defense Attorney knows that many drivers who end up being charged with DUI or DWI are initially pulled over because they failed to stop at a stop sign or stop light, were speeding, swerving within their lanes on the street or highway, or even had expired vehicle registration tags. If you have been arrested for drinking and driving, call the attorneys at Kestenbaum, Eisner & Gorin, LLP today at 1-877-781-1570 to speak to an aggressive and experienced

An unidentified Garden Grove man is suspected of driving under the influence of alcohol (DUI) last night when he crashed into an Orange County memorial around 7 o'clock in the evening. The driver reportedly damaged a gate, knocked down a light pole, jumped a curb and drove through a small block wall before allegedly plowing into the Orange County Fire Authority's Eternal Flame memorial in Irvine. The accident is said to have extinguished the eternal flame. The driver was taken to a nearby hospital and reportedly treated for a broken foot. He was expected to be arrested on suspicion of DUI after being released from the hospital.

Los Angeles DUI Defense Attorney by your side during your legal proceedings can mean the difference between preserving your freedom and having to spend time in jail. For many people, dealing with DUI charges is the first (and hopefully the only) time they have to deal with the Los Angeles criminal justice system. Unguided, that can be an intimidating experience. But with a capable
Los Angeles DUI Defense Attorney at your side, you can move confidently through your case, knowing you are being properly taken care of. For example, your
Los Angeles DUI Defense Attorney knows that you have just ten days from the time of your arrest to schedule a trial with the California Department of Motor Vehicles (DMV), or you risk losing your driving privileges until the criminal portion of your case is resolved. An experienced attorney also knows that blood alcohol science and field sobriety tests are not always the most accurate way to determine whether or not a driver was impaired by alcohol at the time of a police stop or accident. Field sobriety tests in particular are highly subject to the opinions of the law enforcement agent administering them, and signs of alcohol impairment can easily be mistaken for what may actually be simple fatigue or illness. Breath analysis (also known as "Breathalyzer") tests can also be unreliable as the machines that calculate blood alcohol content need frequent cleaning and recalibration to be accurate. Residues from repeated usage throughout an evening can also collect in the machine and lead to falsely high readings towards the end of the night. If you are facing DUI charges, call the

Actor Ryan Merriman was arrested for driving under the influence of alcohol (DUI) last week in Newport Beach about 90 minutes south of Los Angeles. Merriman, who is 28 years old, was driving through Newport Beach when local law enforcement officials spotted him rolling past the solid white line at a stoplight. After pulling the actor over, police arrested him on suspicion of driving under influence of alcohol and took him to a nearby jail. No word has been given as to when Merriman is next expected in court. Merriman is perhaps best known for his work on the film "Final Destination 3," which was released in 2006. More recently, the actor has worked on the television show "Pretty Little Liars."

Los Angeles DUI Defense Attorney can tell you that before local law enforcement agents can pull you over on suspicion of DUI, they must first observe you driving either dangerously or in some way illegally. In Merriman's case, officers saw the actor not stop before the solid white line just before a stop light at an intersection. In many cases, especially on weekend nights and in areas near bars and clubs, local law enforcement agents actively look for people who do not properly stop at stop signs, people who are speeding or swerving in their lanes, or even people with expired vehicle registration to pull over. An experienced
Los Angeles DUI Defense Attorney knows that most of these stops are simply pretexts to see if drivers are actually impaired because of alcohol consumption. If you are facing DUI charges, a thorough

Disney star Mitchel Musso was arrested for driving under the influence of alcohol (DUI) several weeks ago after he failed to slow down for local law enforcement agents who were directing traffic around an unrelated accident in Burbank. Musso, who is best known for playing Oliver Oken in the Disney Channel's popular television show "Hannah Montana," was pulled over in his black 2007 Mercedes Benz around 3:45 in the morning on October 17th. Upon approaching Musso's vehicle, officers at the scene noticed the strong odor of alcohol coming from his vehicle and asked the actor to step outside and perform a few field sobriety tests. After performing poorly on the field sobriety tests, Musso was asked to take a breath analysis (also known as a "breathalyzer") test, where he reportedly blew well above 0.08%, which is the legal blood alcohol concentration limit for people of legal drinking age. Further complicating matters, Musso, who is only 20 years old, is not technically old enough to be consuming alcoholic beverages. Musso was arrested on suspicion of DUI and taken to a nearby jail, where the actor's bail was set at $5,000.

As any Los Angeles DUI Defense Attorney can tell you, the state of California has a "zero tolerance" policy when it comes to underage drinkers. What that means is that while for people ages 21 and older, the legal threshold for blood alcohol concentration before a person will likely be charged with driving under the influence of alcohol is 0.08%, for drivers under the age of 21, that blood alcohol concentration threshold is just 0.01%. If you are under the age of 21 and have been arrested for DUI, call the offices of Kestenbaum, Eisner & Gorin, LLP today at 1-877-781-1570 to speak to an experienced and skilled
Los Angeles DUI Defense Attorney about your case. An experienced and knowledgeable
Los Angeles DUI Defense Attorney knows that for an person under the age of 21, getting a blood alcohol concentration of 0.01% can easily be accomplished even if you are not consuming alcohol. Breath sprays and mouthwashes routinely include small amounts of alcohol in their ingredients, and certain health conditions, diets or illnesses can change the chemistry of your mouth and make it look as though you have been drinking, even if you have not. A good
Los Angeles DUI Defense Attorney also knows that being tired or sick can easily lead to poor performances on field sobriety tests, which are highly subjective to begin with. If you are under the age of 21 and have been arrested for DUI, you might feel as though you do not have many options, but you do. Call the offices of Kestenbaum, Eisner & Gorin, LLP today to find out what they are.

Radio personality and former Tribune Company Chief Executive Officer Randy Michaels was arrested for drinking and driving in the early morning hours last Friday. Michaels, whose real name is Benjamin Homel, was found by a local law enforcement agent in a muddy construction zone just outside of Cincinnati, Ohio. Michaels' vehicle was surrounded by water that reached the vehicle's carriage. Upon approaching the vehicle, the officer at the scene described Michaels as having bloodshot eyes and slurred speech. Michaels was asked to perform several field sobriety tests, including walking in a straight line and standing on one foot, which he performed poorly on. Michaels was arrested and taken to a local jail, where, after consulting with an attorney, he refused to take a breath analysis (also known as a breathalyzer) test to determine his blood alcohol content. Michaels was also cited for driving in a construction zone. Michaels is so far pleading not guilty, but a court date has not yet been announced. The media industry veteran was forced to resign amid scandal as CEO of Tribune Co. last year after allegations of raunchy, frat-boy-like behavior on the job surfaced. Michaels rebounded, however, after forming a new media company this past June.

While Michaels' arrest occurred in Cincinnati, any experienced Los Angeles DUI Defense Attorney can tell you that drinking and driving is also taken very seriously here in Los Angeles. If you have been arrested for driving under the influence of alcohol (DUI) or driving while intoxicated (DWI), you need to find yourself a capable and experienced
Los Angeles DUI Defense Attorney right away. Having the right
Los Angeles DUI Defense Attorney by your side can mean the difference between having to go to jail and having charges reduced or dismissed altogether. An aggressive
Los Angeles DUI Defense Attorney will call into question the accuracy of both Field Sobriety Tests and breath tests, both of which are notoriously inaccurate in determining a person's actual impairment or sobriety while driving. Field sobriety tests are not always accurate predictors of alcohol impairment because balance, coordination and mental function are often times impaired by non-alcohol-related health issues such as illness or fatigue. An experienced
Los Angeles DUI Defense Attorney can also tell you that breath tests have been heavily scrutinized in recent years because of their inaccuracy. Many different models of breath analysis machines are notoriously difficult to keep completely clean and correctly calibrated, which can lead to falsely-high test results for many people. If you have been charged with DUI or DWI, call the offices of Kestenbaum, Eisner & Gorin, LLP today at 1-877-781-1570 to speak to an experienced
Los Angeles DUI Defense Attorney about your case.

Professional wrestling star Jimmy Uso (whose real name is Jonathan Fatu) was arrested for driving under the influence of alcohol (DUI) last week while down in Florida. Uso, who currently works with World Wrestling Entertainment (WWE), was spotted by a local law enforcement officer in Tampa at around 3 o'clock in the morning on September 29th driving the wrong way on a one-way street. The officer who pulled Uso over described the wrestler as showing several signs of alcohol impairment, including slurring his speech and being glassy-eyed at the scene. Uso was given a breath analysis (also known as "breathalyzer") test, which showed his blood alcohol content to be 0.18% --more than twice the legal limit of 0.08% in Florida. Uso, who is the second cousin of wrestler and actor Dwayne "The Rock" Johnson, was taken to a local jail and later released after posting $500 bail.

While it seems like a new celebrity or athlete gets arrested for DUI every day, any Los Angeles DUI defense attorney can tell you that DUIs are serious business that can land you in jail. If you have been arrested for drinking and driving, the first thing you need to do is find an experienced and skilled

A Lancaster woman was charged with driving under the influence of alcohol (DUI) following a horrific crash that left six children injured in late September. Stanesha Nicole Allen was driving through city streets shortly after 5 o'clock in the morning on September 26th when she reportedly lost control of her Toyota Sequoia. According to reports, the vehicle flipped four times and at least two children were partially ejected from the vehicle. Two children were airlifted from the scene of the accident to a nearby hospital with what are described as major injuries. Allen and four other children were taken by ambulance to a nearby hospital for injuries ranging from minor to moderate. According to reports, Allen's blood alcohol content was reportedly 0.08% just after the accident. Allen, who is the biological mother of three of the children, foster mother to two and aunt of another child involved in the accident, was charged with six counts each of child abuse and child restraint law violation, and one count each of causing bodily injury while driving under the influence of alcohol and driving with a blood alcohol content of 0.08% while causing bodily injury. Allen is being held in police custody in lieu of paying $1.7 million bail and, if convicted, could face up to 19 years in prison. She has pleaded not guilty.

As any experienced Los Angeles DUI defense attorney can attest, being involved in a DUI crash is serious business. That same
Los Angeles DUI defense attorney can also tell you that a DUI crash or even roadside stop with a child under the age of 14 can make a bad legal situation even more precarious. For many first-time DUI offenders, a Los Angeles DUI defense attorney knows that probation and fines are the most typical punishments upon conviction. However, certain factors such as speeding, prior convictions and involving children under the age of 14 in your DUI incident can land you in a Los Angeles County Jail or even a California State Prison, potentially for several years. If you have been arrested for drinking and driving, call the offices of Kestenbaum, Eisner & Gorin, LLP today at 1-877-781-1570 to speak to an experienced and skilled
